By purchasing or using Pulse Music Visualizer ("Software"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use our Software.
2.1 Pro License: Upon purchase, you are granted a perpetual, non-exclusive, non-transferable license to install and use Pulse on up to three (3) devices simultaneously.
2.2 Enterprise License: Upon purchase, you are granted a perpetual, non-exclusive license to install and use Pulse on up to ten (10) devices simultaneously.
2.3 Trial Version: You may use Pulse in trial mode without purchase, with limited features and watermarked recording output.
You may NOT:
4.1 Pro and Enterprise Licenses: You may use recordings and outputs from Pulse for commercial purposes, including but not limited to YouTube videos, live streams, commercial events, and client projects.
4.2 Trial Version: Commercial use of watermarked trial outputs is permitted, but the watermark must remain visible.
4.3 Attribution: While not required, we appreciate attribution when using Pulse in commercial projects.
5.1 Payment Processing: All payments are processed securely through Paddle.com. We do not store your payment information.
5.2 Pricing: Prices are subject to change. Your purchase is honored at the price displayed at checkout.
5.3 Refunds: We offer a 30-day money-back guarantee. Contact support@evolvianpulsemv.com for refund requests. Refunds are processed within 5-10 business days.
5.4 Chargebacks: Unauthorized chargebacks will result in immediate license revocation and may affect future purchases.
6.1 Delivery: License keys are delivered via email immediately after purchase.
6.2 Security: You are responsible for keeping your license key secure. Lost keys can be retrieved by contacting support with proof of purchase.
6.3 Hardware Binding: Licenses are bound to specific hardware configurations. You may deactivate a device to free up an activation slot.
6.4 Transfer: License keys are non-transferable and cannot be sold or given to others.
7.1 Updates: All license holders receive free updates for the lifetime of the product. We reserve the right to discontinue updates at any time.
7.2 Support: Pro license includes email support. Enterprise license includes priority support. Response times are typically 24-48 hours.
7.3 Compatibility: We strive to maintain compatibility but cannot guarantee the Software will work on all hardware configurations.
8.1 Ownership: Pulse and all associated intellectual property remain the property of Evolvian.
8.2 Your Content: You retain all rights to music files, visualizations, and recordings you create using Pulse.
8.3 Trademarks: "Pulse" and associated logos are trademarks of Evolvian. Unauthorized use is prohibited.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT SHALL EVOLVIAN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SOFTWARE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Evolvian is registered, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of Pulse after changes constitutes acceptance of the new Terms.
